Blake Lively is attempting to withdraw certain claims in her lawsuit with Justin Baldoni
Blake Lively has attempted to withdraw two of the claims she made about her “It Ends With Us” co-star and director, Justin Baldoni.
Lively is looking to withdraw the claims of intentional infliction of emotional distress and negligent infliction of emotional distress, according to Variety.
The move came after Baldoni’s lawyers requested medical information related to the claims, which say she suffered “severe emotional distress and pain, humiliation, embarrassment, belittlement, frustration and mental anguish.”
Per documents obtained by the outlet, Baldoni’s lawyers are asking her to sign a HIPAA release to access therapy notes and other materials.
In their filing Monday, they stated Lively has refused and is only withdrawing the claims to “simultaneously: (a) refuse to disclose the information and documents needed to disprove that she suffered any emotional distress and/or that the Wayfarer Parties were the cause; and (b) maintain the right to re-file her [infliction of emotional distress] claims at an unknown time in this or some other court after the discovery window has closed Ms. Lively cannot have it both ways."
Lively’s lawyers told Variety the filing was “a press stunt” and said they are “streamlining and focusing” her case.
The courts have to now decide whether to compel Lively to turn over her medical information or dismiss the two claims, with or without prejudice. If dismissed with prejudice, it means Lively cannot re-file the claims later.
The “A Simple Favor” star’s lawyers made another filing of their own, urging sanctions against Baldoni’s attorneys for abuse of the court docket and requested their motion be denied and struck.
Lively and Baldoni’s legal battle goes back to December of 2024, when Lively first filed a lawsuit against him and “It Ends With Us” film producer Jamey Heath for sexual harassment, retaliation, and emotional distress in the California Civil Rights department and then federal court.
Baldoni then filed a $400 million lawsuit against Lively and her husband, Ryan Reynolds, accusing them of defamation.
Since then, multiple filings and public statements have gone back and forth, with the case yet to go before a judge until March of 2026.
