Diddy prosecutors oppose bail, seek 'substantially higher’ prison sentence
Prosecutors in the Sean “Diddy” Combs trial are seeking a “substantially higher” prison sentence for the disgraced music mogul.
In a written submission made late Thursday at a Manhattan federal court, they also oppose his request to be released on $50 million bail while he awaits his October 3 sentencing hearing.
Combs was acquitted of racketeering conspiracy and sex trafficking charges carrying potential life prison terms but was convicted of two counts of transportation to engage in prostitution for arranging for girlfriends and male sex workers to travel to engage in sexual encounters that he filmed in early July.
Each prostitution-related charge carries a potential maximum 10 years in prison.
After the verdict, prosecutors thought the federal sentencing guidelines would call for four or five years, but they now believe the guidelines range “will be substantially higher.”
With that potentially longer sentence, they believe there is a higher risk Combs would possibly flee.
Combs’ lawyers have said, based on the guidelines, they expect a 21 to 27 month sentence.
The disgraced music mogul was previously denied bail by Judge Arun Subramanian, who said, Combs had not met the burden of showing by clear and convincing evidence a “lack of danger to any person or the community.”
Combs lawyers, Marc Agnifilo, filed a renewed request for bail Tuesday, citing cases similar to Combs’ where defendants received bail, as well as the severe conditions of the Metropolitan Detention Center in Brooklyn.
Agnifilo also said Combs was being unfairly treated for his “swingers” lifestyle.
Prosecutors said in their Thursday filing that Combs’ conviction carried mandatory requirements that he remain in jail until sentencing unless he can prove exceptional circumstances, which they said he cannot.
They also said the cases cited by Agnifilo are not comparable to Combs’ case and conditions at the federal lockup had improved before Combs time there.
